Notes:
1. The amount in dispute includes the total value of the claims including any counterclaim. Where there are active proceedings this assessment is based on the amounts set out in the parties' pleadings, otherwise based on figures set out in any letter of claim or equivalent. Non-monetary claims e.g. land disputes, certain procurement challenges, declarations etc, the dispute value is calculated by reference to the value of the underlying asset, with a minimum fee of £1,500 per party.
2. Day Fees cover a seven hour mediation day, four hours of preparation time and travel time. Time spent beyond a seven hour day is charged at £200 per party per hour. Non-monetary claims e.g. land disputes, certain procurement challenges, declarations etc, the dispute value is calculated by reference to the value of the underlying asset, with a minimum fee of £1,500 per party.
3. Travel, accommodation and other expenses will be charged at cost.
4. Payment: mediation fees are due in cleared funds before the mediation day. Charges for expenses and overtime are to be paid within seven days of invoice.
5. Cancellation / Postponement:
Cancellation 7 or more days before the mediation date, no fee will be charged.
Cancellation 72-144 hours before the mediation date, 50% of the fee will be charged.
Cancellation within 72 hours of the mediation date, 100% of the fee will be charged.
